Judge Rules House Dems Can Get Some of Trump’s Tax Records From Accounting Firm

After the raid on former President Donald Trump’s Florida home a federal judge has decided that the Democrats can get his tax returns.

The decision was unanimous, 3 – 0, from the DC Circuit Court of Appeals on Tuesday but the former president can still appeal, CNN reported.

The court said that the judgment would not be made for seven days in order to give the former president time to appeal.

“While it is possible that Congress may attempt to threaten the sitting President with an invasive request after leaving office, every President takes office knowing that he will be subject to the same laws as all other citizens upon leaving office. This is a feature of our democratic republic, not a bug,” Judge David Sentelle said.

“In this case, the need for the Trump Parties’ information to inform potential legislation overrides the burden to the Executive Branch largely because that burden is so tenuous,” he said.

“The Chairman of the United States House of Representatives Committee on Ways and Means filed a statutory request for documents from the Department of the Treasury related to then-President Donald J. Trump and related entities,” the court said. “Treasury initially objected to the request, and the Committee filed this lawsuit. After a change of administrations, Treasury acquiesced, stating that it intended to comply with the request. In the meantime, the Trump Parties intervened in the action. The district court ruled in favor of the Committee. Intervenors appeal. For the reasons set forth below, we affirm.”

“As a general rule, Title 26, Section 6103 of the United States Code makes tax returns and return information confidential unless their release is authorized by an exception enumerated in that same section,” it said. “26 U.S.C. § 6103(a). Section 6103 includes a number of exceptions to the general rule of confidentiality but only one is at issue here. Section 6103(f)(1)provides that [u]pon written request from the chairman of the Committee on Ways and Means of the House of Representatives . . . the Secretary shall furnish such committee with any return or return information specified in such request . . . . 26 U.S.C. § 6103(f)(1). At bottom, this case simmers down to the constitutionality and application of § 6103(f)(1). Operating separately from § 6103(f)(1), IRS regulations give the President’s tax returns special consideration.”

“While IRS audits are often random, the IRS has required the audit of the sitting President’s tax returns since 1977,” it said. “This Presidential Audit Program is a creature of IRS regulations and is not required or governed by statute.”

“Against both the Committee and Treasury, the Trump Parties asserted that the Request lacks a legitimate legislative purpose and violates the separation of powers. Against Treasury, the Trump Parties alleged that § 6103(f)(1) is facially unconstitutional and that compliance with the Request would be a violation of the First Amendment,” it said.

Republican Florida Gov. Ron DeSantis has come to the defense of former President Donald Trump after the FBI raided his Florida Mar-a-Lago home.

“The raid of MAL [Mar-a-Lago] is another escalation in the weaponization of federal agencies against the Regime’s political opponents, while people like Hunter Biden get treated with kid gloves,” he said on Twitter. “Now the Regime is getting another 87k IRS agents to wield against its adversaries? Banana Republic.”

And he was not the only Republican to respond with furiousness after the raid.

“The @FBI’s raid of Mar-a-Lago is incredibly concerning, especially given the Biden admin’s history of going after parents & other political opponents. This is 3rd World country stuff. We need answers NOW. The FBI must explain what they were doing today & why,” Republican Florida Sen. Rick Scott said.

“The FBI isn’t doing anything about the groups vandalizing Catholic Churches, firebombing Pro-Life groups or threatening Supreme Court justices But they find time to raid Mar A Lago,” Republican Florida Sen. Marco Rubio said.

“Biden is playing with fire by using a document dispute to get the @TheJusticeDept to persecute a likely future election opponent Because one day what goes around is going to come around And then we become Nicaragua under Ortega,” he said.

“The @FBI raid on President Trump was approved by Director Wray, who also claimed that the illegal FISA warrants used to spy on Trump were constitutional. Today’s raid is outrageous and unjust, but predictable,” Sen. Rand Paul said.

“Executing a warrant against ex-POTUS is dangerous. The apparent political weaponization of DOJ/FBI is shameful. AG must explain why 250 yrs of practice was upended w/ this raid. I served on Benghazi Com where we proved Hilliary possessed classified info. We didn’t raid her home,” Mike Pompeo said.

“The FBI raid on Trump’s home tells us one thing. Failure is not an option. We must destroy the FBI. We must save America. I stand with Donald J. Trump,” Rep. Paul Gosar said.

“I’ve seen enough. The Department of Justice has reached an intolerable state of weaponized politicization,” House Minority Leader and California Rep. Kevin McCarthy said. “When Republicans take back the House, we will conduct immediate oversight of this department, follow the facts, and leave no stone unturned.”

“Attorney General Garland, preserve your documents and clear your calendar,” he said.
